Abstract:
The report examines the issues of mandatory mediation as a prerequisite for initiating legal proceedings and the right of access to justice as one of the fundamental rights. It considers the new decisions of the national legislator through the lens of the guaranteed ability of citizens and legal entities to turn to the courts in the presence of a legal dispute. A critical analysis of Decision No. 11 dated July 1, 2024, on const. case No. 11/2024 by the Constitutional Court, has also been made.
