THE MEDIATION IN THE DIFFERENT PUBLIC SPHERES, 2025, issue 5, 95-104

Abstract: The report argues that mediation is applicable in disputes between a state and an investor, primarily within a hybrid mediation-arbitration model. Among the advantages of mediation in such disputes is its ability to consider all parties' interests, which makes it particularly suitable for addressing political and public matters. The main disadvantages are related to the fact that mediation is not typically provided for in international investment treaties, as well as the lack of enforceability of agreements resulting from mediation.
