Abstract:
Limited open surrogacy can help many couples of childbearing age solve their fertility problems, which aligns with the basic concept of fairness and justice. Facing the great demand for surrogacy and the chaotic underground surrogacy, China’s attitude toward banning surrogacy is worth pondering. China has permanently attached great importance to ethics, and the complete prohibition of surrogacy is not a good policy. The realization of limited legalized surrogacy needs regulation and the harm brought by limited legalized surrogacy can be avoided as much as possible by restricting the qualifications of the entrusting party, modifying the conditions of surrogate mothers, and strictly reviewing the surrogacy agreement.
