Enforcement of IPRs in ASEAN

Abstract: This chapter commences with an examination of IPR enforcement in the context of ASEAN regional integration. In this regard it surveys the ASEAN IPR Action Plan 2016-2025, which was adopted by ASEAN Member States (AMS) in 2016, and the associated ASEAN IPR Enforcement Action Plan. For an analysis of the state of IPR enforcement in ASEAN, account is taken of the assessment of the reports on AMS in the US Trade Representative’s 2021 Special 301 Report and in the European Commission’s 2021 Report on the Protection and Enforcement of Intellectual Property Rights in Third Countries. Finally, the chapter looks at the IPR enforcement arrangements arising from the EU negotiations with ASEAN for a region-to-region free trade agreement (FTA) and the associated bilateral FTAs negotiated by the EU with a number of AMS.
