Abstract:
The chapter discusses the development of intellectual property laws in Malaysia. The laws relating to copyright, patents, industrial designs, registered trademarks, geographical indications, semi-conductor chips, and plant varieties are based on statutes, whereas the laws on passing off and protection of confidential information are based on the common law. A section on membership of the various international conventions and agreements on intellectual property, as well as ratification of various free trade agreements, is also provided. This is followed by a discussion of the gist of the various intellectual property laws, including the leading cases on these areas. Sections on enforcement procedures (civil, criminal and administrative), institutional infrastructure, statistical information of IP filing and enforcement follow. The chapter ends with a summary of the status under the US Special 301 Report and the various IP-related policies initiated by the government to enhance the economic progress of the nation.
