The state of intellectual property protection in the Philippines: What lies ahead?

Abstract: With the recent developments in IP legislation and policy initiatives, the Philippines had taken enormous strides in terms of IP protection, enforcement, and education. For the government, and all IP stakeholders, the challenge is not only to maintain status quo but also to provide more than enough leeway for the existing IP infrastructure and the prevailing IP culture to adapt and evolve with the changing times. This chapter provides a clear perspective on how IP is embedded in the Philippines. The chapter includes an overview of historical underpinnings, and the legal basis of IP protection that includes national laws and jurisprudence, procedure, treaties, conventions, and international agreements. The chapter also discusses existing IP-related institutional structures and policy initiatives on IP that define the state of IP affairs in the country. In all, this chapter provides guidance on how far the Philippines has gone in terms of IP protection, enforcement, and education, what else it can do, and what more it can achieve in the foreseeable future.
