Brunei Darussalam: Building an intellectual property system for a knowledge and innovation economy

Abstract:
The government of Brunei Darussalam launched the national development plan known as Wawasan Brunei 2035 to guide the process of shifting the country away from a resource-driven economy to a knowledge and innovation economy. One of the areas the government has focused on achieving this goal is improving the environment for local businesses and foreign investors, including strengthening the protection of intellectual property rights (IPRs). This chapter reviews Brunei’s legal framework for the protection and enforcement of IPRs and discusses changes adopted to strengthen the IPR system to support the government’s development policies. It argues that while the government has actively adopted legal reforms to modernise its IPR system and promote the creation of a knowledge and innovation economy, it has achieved limited success with regards to the latter goal and the country still relies heavily on the oil and gas sector.
