Chapter 10 in The Economic Analysis of Civil Law, 2022, pp 300-354 from Edward Elgar Publishing
Abstract:
This chaper provides an overview on important special subject of tort law, such as poduct liability, environmental liability, liability for pain and suffering and deals with the conditions under which tort law is structurally unfit to reach its policy targets, as in cases of widespread damages and a rational apathy of victims to claim their damages, when tortfeasors are judgment proof or when damages are not covered by civil liability.
