Abstract:
This chapter focuses on the determination of eligibility of refugees for resettlement by UNHCR based on its resettlement submission categories, and the selection procedure by states following referrals of selected cases by UNHCR. States apply additional criteria such as integration potential - in essence migration criteria - and quite a host of exclusion criteria. There is, in short, a discrepancy between the need for protection elsewhere as captured in UNHCR’s resettlement submission categories, and the liberal criteria that are extraneous to need for protection states apply.
