War, terrorism and criminal justice

Chapter 4 in A Research Agenda for Global Crime, 2019, pp 47-65 from Edward Elgar Publishing

Abstract: The modern agenda for the criminalization of international armed conflict and war originated in the optimism of the post Second World War period and the Nuremberg trials. Changes in the structure of international society resulting from globalization have both fatally undermined the general project while at the same time producing conditions favourable to limited criminalizing interventions in armed conflict. Modern terrorism has further undermined the criminalization project and indeed raises the prospect of the militarization of domestic criminal justice.
