International administrative tribunals

Abstract: International administrative tribunals are judicial bodies established by international organizations to adjudicate disputes between staff members and the organization. This chapter highlights the specificities of the procedures before those tribunals, focusing on the administrative tribunals of the UN, the ILO and the World Bank. It discusses jurisdiction, admissibility, stay of proceedings, joinder, representative cases and class actions, provisional relief, third-party participation, legal representation, written and oral proceedings, evidentiary issues, judgments, remedies, and post-judgment issues. The survey of these topics demonstrates that international administrative tribunals often face similar procedural problems and, more often than not, approach them in a similar manner: either through their statute and rules of procedure or through practice. To the extent that the tribunals share certain fundamental procedures, the international civil servants enjoy the same procedural guarantees regardless of their employer. More importantly, those shared fundamental procedures ensure that all staff members have a fair hearing and thus that due process is ensured.
