Abstract:
This chapter explores procedural questions associated with judgments and the termination of proceedings, with a focus on the procedure of the ICJ, the ITLOS, inter-state arbitration and certain ‘mixed’ proceedings between private parties and states. Every court or tribunal has particular features when it comes judgments, awards, subsequent remedies and discontinuance. These institutional settings share certain features that arise out of common principles and practices. The chapter concludes, however, that those common features do not derive from any common normative source.
