The proliferation of international courts and tribunals and its effect on procedure in the settlement of international disputes

Abstract: The ongoing multiplication of international courts and tribunals inevitably leads to a growing density in relations between them. In spite of differences in their respective mandates there are increasing points of contact. This chapter addresses the proliferation of international courts and tribunals and its procedural aspects. In particular, it sheds light on the consequences of the jurisdictional parallelism such as inter-judicial dialogue and potential cross-fertilization of procedural law among international courts, as well as on procedural solutions to overlapping jurisdictions.
