Protecting the rights of migrant workers through trade mechanisms: lessons from NAFTA

Abstract:
This entry revisits the migrants' rights cases filed under the NAFTA side labor accord to understand how trade based labor rights mechanisms have performed as avenues to protect and promote labor rights. Review of the cases finds that while resolutions through the formal case process can be limited, subsequent outcomes mandated by Ministerial Agreements or follow up can result in important gains, including for teaching workers about their rights, in promoting binational cooperation on the rights of migrants, and in limited cases, policy changes. Even as panel resolutions are limited, the subsequent outcomes favorable to workers have not been possible without first filing a case.
