Chapter 3 in Litigating the Environment, 2023, pp 58-105 from Edward Elgar Publishing

Abstract: Based on a typology of international environmental obligations that categorizes them as bilateral or collective, this chapter analyses how the rules on standing need to be adapted based on which type of obligation is invoked. It focuses particularly on public interest litigation and how such concept can help in the resolution of environmental disputes. It also looks at how different actors – state and non-state alike – can participate in an international judicial procedure.
