Chapter 5 in Litigating the Environment, 2023, pp 148-179 from Edward Elgar Publishing

Abstract: This chapter tackles how provisional measures can be a tool in preventing environmental harm and protecting the environment. As judicial procedures tend to not only be reactive but also lengthy, they can fall short of effective prevention of environmental harm. Awarding provisional measures can remedy this situation. Therefore, this chapter analyses how such provisional measures can be applied in environmental disputes.
