Transitional justice

Chapter 40 in Research Handbook on Third World Approaches to International Law (TWAIL), 2025, pp 484-498 from Edward Elgar Publishing
Abstract:
Transitional justice is an enigmatic space that gathers various approaches in confronting a community's violent past. The violence in transitional justice is not about specific individuals but on mass violence. Given the field's breadth and scope, this contribution offers a TWAIL approach to transitional justice. This approach is contingent on my own reading of the field, based on my own politics, and is informed by my own lived experience in what are now known as ‘Canada’ and ‘Sri Lanka’. I will first provide a brief overview of the field of transitional justice by setting out its foundational elements. Then I will explore several themes of transitional justice focusing on reconciliation, truth, accountability, reparations, and reform.
