Abstract:
This chapter presents a Third World Approaches to International Law (TWAIL)-oriented examination of intellectual property (IP) rights. It critiques the entrenched power asymmetries that shape international IP regimes and advocates for TWAIL interventions to reimagine them. The chapter focuses on three pressing categories of IP rights: pharmaceutical patents, plant variety protection and geographical indications. In addition, it advances a TWAIL approach to IP scholarship and praxis. The chapter concludes by emphasizing the need to promote TWAIL-informed IP regimes at national, regional and international levels.
