The question of Palestine

Abstract:
This chapter seeks to contribute to understanding of the question of Palestine in relation to the Third World Approaches to International Law (TWAIL) principles and analysis. It examines the settler-colonial regime that has persisted since the 1948 War, known as Al-Nakba (‘The Catastrophe’), which resulted in the mass expulsion of Palestinians from their homeland and the ongoing processes of dispossession referred to as the ‘ongoing Nakba’. The chapter begins by highlighting the relevance of TWAIL principles to the Palestinian context, then critically assesses the limited engagement with Palestine within TWAIL scholarship and explores potential reasons for this gap. Finally, it argues that a more robust application of TWAIL-informed perspectives on settler-colonialism could provide a just and equitable framework for addressing the question of Palestine, and advancing future scholarship and advocacy on the issue.
