Abstract:
In recent decades, Indigenous peoples have emerged as influential actors in global governance, advocating for their rights at international and regional levels with varying degrees of success. This chapter examines the growing recognition of Indigenous rights within international law, exploring key concepts such as self-determination, procedural rights, cultural and land rights, and the intersection of Indigenous rights with international environmental law. It further provides a comparative analysis of how regional legal systems—specifically the African, Inter-American, European, and Asia-Pacific human rights frameworks—address Indigenous rights. The pivotal roles of the United Nations and Indigenous organizations in advancing these rights are also highlighted. Additionally, the chapter reflects on the complex relationship between Indigenous rights and global governance, offering critical insights. Finally, it identifies potential avenues for future research in this evolving and significant field.
