Abstract:
Article 18 imposes on foreign representatives an ongoing duty to inform the receiving court of any substantial changes in their status, the status of the foreign proceeding and the existence of any other foreign proceedings involving the same debtor that become known to them after recognition. This provision is designed to bring to the court’s attention matters that might require termination or modification of the recognition or the relief provided and to enable it to tailor the relief as necessary to coordinate and cooperate with the other pending foreign proceedings.
