Chapter 2 in EU Digital Law, 2026, pp 61-157 from Edward Elgar Publishing

Abstract: Prior to examining the legal framework introduced by the Digital Services Act, the rules on the provision of information society services under the E-Commerce Directive and its interplay with the internal market are presented. In addition to the details of the conditional liability exemptions for providers of intermediary services, this chapter discusses the due diligence obligations imposed on digital service providers, such as hosting services and online platforms, by the Digital Services Act. Its interaction with other instruments imposing further obligations to intermediary service providers is explored on issues such as product liability, product safety, short-term accommodation, and platform work. Finally, this chapter examines the adaptation of the Audiovisual Media Services Directive in a context of increasing convergence with information society services, as illustrated by video-sharing platform services. Media freedom and the implications of the European Media Freedom Act and the SLAPP Directive are also discussed.
