Abstract:
The application of EU rules on unfair commercial practices is analysed with a special focus on their adaptation to the evolving practices of online platforms and other providers of digital services. The scope and implications of the restrictions on advertising and commercial communications are detailed, also covering those that concern trade in specific products or services, such as medical products and gambling. The EU antitrust regulatory framework is presented, including the significance of the block exemption regulation on vertical agreements for online sales and platforms, and the application of the rules on abuse of dominant position to the digital sector. The implications of the Digital Markets Act as an instrument supplementing EU competition rules are highlighted, including the gatekeeper designations, the obligations applicable to those gatekeepers and the enforcement mechanisms.
