Special jurisdiction - Articles 7-9

.

Chapter 2 in The Brussels I-bis Regulation, 2023, pp 76-219 from Edward Elgar Publishing

Abstract: This chapter deals with special jurisdiction in Articles 7-9 of the Regulation. Thereby the predominant part of the analysis is devoted to jurisdictional rules for contractual obligations and for torts in Article 7(1) and 7 (2) respectively. These matters have generated the largest number of questions submitted to the CJEU for preliminary ruling. A critical assessment of the current state of law, in particular the part created by the relevant CJEU jurisprudence, is a method used throughout all chapters.
