Disabilities, evidence-making and quality of life: the three core human rights principles framework

Abstract: Indicators of quality of life (QoL) in the clinical and economic models used for policy deliberations may distort or undervalue the experiences of people with disabilities. This chapter proposes a human rights-based approach to evidence-making in relation to the QoL of people with disabilities, reflecting the values and preferences of this population. This framework is grounded in three core principles of international human rights law, derived from the International Covenant on Economic, Social and Cultural Rights (ICESCR): non-discrimination, fair procedure, and progressive realisation. I refer to this framework as the three core principles of evidence-making and apply it to deliberations using health-related quality of life (HRQoL). In this model, states have a positive obligation to pursue better evidence-making to fully reflect the interests and values of people with disabilities
