Chapter 10 in The Social and Legal Impact of Autonomous Vehicles, 2025, pp 115-129 from Edward Elgar Publishing
Abstract:
Chapter 10 will delve into the ‘traffic law’ concept, emphasizing its technical and formal nature. The chapter explores the distinction between intrinsically wrongful actions (mala in se) and those prohibited by law (mala prohibita) within traffic law, aiming to understand compliance and non-compliance with legal regulations. We also discuss the concept's implications for autonomous vehicles and possible so-called relation to our existing traffic laws.
