General introduction: fisheries disputes and the 1995 United Nations Fish Stocks Agreement

Alexandros X.M. Ntovas

Chapter 1 in Fisheries Compatibility Disputes, 2026, pp 1-39 from Edward Elgar Publishing

Abstract: This introductory chapter explores the rising tensions leading to international fisheries disputes amidst ongoing challenges to achieving ocean sustainability. It outlines the normative development of international fisheries law through key United Nations initiatives, emphasizing the central role of peaceful dispute settlement in fostering international cooperation. The chapter further places its focus on article 7 of the 1995 United Nations Fish Stocks Agreement, which addresses the compatibility of conservation and management measures. This provision marks a significant step forward in the regulation of straddling and highly migratory fish stocks, building upon the legal framework established by the 1982 United Nations Convention on the Law of the Sea. By examining the legal construction of article 7, the chapter introduces the book's central argument and lays the groundwork for a critical analysis of the compatibility rule within the evolving jurisdictional regime governing the conservation and management of this contentious category of fish stocks under international law.
