Abstract:
Since the 1958 United Nations Fishing and Conservation Convention, international cooperation has been crucial for conserving and managing straddling and highly migratory fish stocks. However, the regulatory regime under the 1982 United Nations Convention on the Law of the Sea has proven insufficient, prompting the adoption of the compatibility rule in article 7 of the 1995 Fish Stocks Agreement. This rule seeks to balance the interests of coastal and distant water fishing States in harmonizing conservation and management measures. Yet, its flexible language has allowed interpretative challenges to resurface. This chapter critically assesses these divergent interpretations and highlights the need for consistent interpretation between the Convention and the Agreement. Article 7 of the Agreement is examined as a response to ecological concerns arising from fragmented governance.
