Chapter 6 in Fisheries Compatibility Disputes, 2026, pp 244-288 from Edward Elgar Publishing

Abstract: Following the United Nations Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks (1993–1995), States renewed their efforts to reform existing Regional Fisheries Management Organizations and Arrangements, and to establish new ones where necessary. While article 7 of the 1995 United Nations Fish Stocks Agreement affirms that conservation and management measures must be compatible across jurisdictional areas, it allows for flexibility to accommodate ecological and geographic special circumstances in each ocean region. This chapter examines the principal regional approaches to implementing the compatibility rule through multilateral cooperation and explores how, in the absence of agreement, compatibility-related fisheries disputes may be referred to third-party dispute settlement procedures.
