An anti-racist feminist agenda for sustainable corporate law

Abstract:
Corporate behaviour to date has thrived on deeply entrenched power norms in corporate law and corporate governance. It is time for new theoretical foundations and perspectives in corporate law and corporate governance. The gendered, colonial and racist histories that have set the agenda for much of our Anglo-American learnings need to be acknowledged across all areas of corporate legal study, rather than siloed off as counter-hegemonic discourse. Colonial theories of the modern corporation underpin our legal and regulatory frameworks and have directly and indirectly influenced how various corporate interests are prioritised and protected. This chapter reflects upon some feminist and anti-racist discourses that identify systemic disadvantages built into our corporate legal and regulatory systems, and paths forward for future research. New agenda items in corporate law are needed that reflect realities on the ground and the real risks facing our world today.
