Beyond intellectual property: lessons on local manufacturing, collaboration, and policy from the pandemic era

Abstract: This chapter builds upon over two decades of research and advocacy in intellectual property and access to medicines, informed by COVID-19 insights. It explores how developing countries struggled with local manufacturing capacity after the TRIPS Agreement, and highlights how the pandemic has exposed the limitations of TRIPS. The author, an experienced access-to-medicines lawyer, assesses pharmaceutical companies’ influence on global IP policies, TRIPS-plus impacts, and the effects of limited local manufacturing capacity. Advocating for a revisiting of the global IP regime in response to global health challenges, the chapter underscores the importance of robust local manufacturing capacity and effective technology transfer. It provides an in-depth analysis of lessons from the pandemic, emphasizing policy reforms and the TRIPS Waiver’s role in addressing health emergencies.
