Receipt of documents by receiving agency
Michael Stürner
Chapter 10 in The European Service Regulation, 2023, pp 96-100 from Edward Elgar Publishing
Abstract:
Article 10 spells out the different possible reactions of the receiving agency upon receipt of a request by the transmitting agency pursuant to Article 8. The provision stresses the quest for efficiency and speed in dealing with requests. Consequently, all steps to be taken by the receiving agency must be carried out ‘without undue delay’, using the decentralised IT system for transmitting documents. However, there are no consequences, or indeed sanctions, for cases in which the receiving agency acts with undue delay.
