Abstract:
The purpose of the chapter is to analyse Article 21 of the Recast Service Regulation, according to which extrajudicial documents may be transmitted to and served in another Member State in accordance with the Regulation. The chapter illustrates the origins of the rule in the Hague Service Regulation and the way in which the transmission and service of judicial documents were dealt with under the previous versions of the Regulation. The chapter goes on to discuss the notion of extrajudicial documents for the purposes of the Regulation and the issues that surround the application of the Regulation itself to such documents.
