Chapter 8 in The European Service Regulation, 2023, pp 86-92 from Edward Elgar Publishing
Abstract:
Article 8(1) spells out one of the most important aims of the Regulation, which is the acceleration of the cross-border service of documents. The Recast Regulation therefore mainly aims at simplifying and streamlining judicial procedures as regards the service of judicial and extrajudicial documents in the Union, while at the same time helping to reduce delays and costs for individuals and businesses. To this end, the Recast Regulation provides for the (non-mandatory) transmission through a decentralised IT system. There are no requirements of legalisation or any equivalent formality.
