Working at the edges of legal protection: Equality law and youth work experience from a comparative perspective

Abstract: Equality law has particular significance for those undertaking unpaid work experience. Drawing on comparative legal doctrinal analysis of equality laws in Australia and the United Kingdom, this chapter considers the extent to which unpaid work experience falls within the scope of equality law. I argue that the extent to which unpaid work experience is covered by equality law varies markedly depending on how work experience itself is viewed. Regardless, it is likely that unpaid work experience is covered in at least some way – and, potentially, multiple overlapping ways – by equality laws in each jurisdiction. Law reform and policy makers should therefore seek to clarify and simplify this legal regime, in a way that makes room for more effective enforcement of equality rights.
