Abstract:
A summary of Canadian industrial design law is provided. The authors explain the fundamentals of Canadian design law, including the procedure for registration of designs under the Canadian Industrial Design Act, and pursuant to the Hague Agreement, as well as alternative strategic modes of design protection pursuant to copyright and trademark law. A review of recent legislative amendments is also provided, along with comments regarding the desirability of certain further revisions of Canadian design law.
