Mandatory human rights due diligence

Abstract: Over the last decade, significant legal developments seeking to implement the United Nations Guiding Principles on Business and Human Rights (UNGPs) have taken place at the domestic, regional, and international level. In particular, various types of laws have been developed in that respect. Some only require companies to disclose information relating to human rights, while others require companies to exercise substantive human rights due diligence (HRDD). The study of mandatory HRDD legislation is particularly relevant in a business and human rights (BHR) course because it underlines the progressive move from soft law to hard law that the BHR field has been undergoing as the responsibility for companies to exercise HRDD set out in the UNGPs is being crystallized into law, creating legally binding obligations for companies.
