Abstract:
Companies may not choose to operate in a zone of conflict. Once operating in a zone of conflict, they face challenges that include whether and when to leave and how to do so. Business and human rights courses should include a section on business and conflict because even where companies are conducting business that may have nothing to do with conflict, they are nonetheless exposed to the conflict, and their actions or inactions may cause or contribute to conflict. Companies face legal, financial, and reputational risks, besides risks to the safety of their staff and assets, in zones of conflict. The United Nations Working Group for Business and Human Rights expects companies to exercise “heightened due diligence” in situations of armed conflict. Companies may also have to act and intervene in conflict situations to assist civilians. Increasingly, they are expected to take political positions with regard to conflict.
