Abstract:
The present contribution explores the increasing engagement of civil society organisations (CSOs) in anti-trust proceedings and the significance of their expertise on digital issues and data protection. It delves into the challenges posed by corporate data concentration and advanced data processing, leading to market dominance and competition issues beyond traditional assessments. Digital platforms act as gatekeepers, controlling access to information and users’ choices, creating a cycle of data collection, profiling and exploitation. The chapter discusses the interplay between competition law and data protection, by drawing heavily on Privacy International's (PI) report ‘Personal Data and Competition: Mapping perspectives, identifying challenges and enhancing engagement for competition regulators and civil society’, which examines the attitudes of competition regulators and CSOs worldwide towards personal data and competition. The authors analyse the main findings of the report, focusing on how competition regulators address the role of personal data in digital markets, CSOs’ engagement with regulators, and emerging trends in their relations.
