Protecting future business with a value-driven IP strategy

Rudolf Freytag

Chapter 7 in Intellectual Property Strategies for Start-ups, 2022, pp 155-190 from Edward Elgar Publishing

Abstract: The task of a company is to create satisfied customers by offering a unique customer value better than its competitors. For this reason, customer value is the right target for the business strategy of every company. Such a business strategy is also called "value driven business strategy" and the corresponding IP strategy is called "value driven IP strategy". Effective protection of a future business and its potential alternatives through a value-driven IP strategy means two things: "Ensure Freedom-to-Operate" and "Prevent imitation". In the start-up world, the "Business Model Canvas" is often used as an instrument for business model development. Start-ups must consider all types of IP rights, from patents to utility models, designs, trademarks and copyrights, and must also consider a forward-looking regional filing strategy. Start-ups pursuing a value-driven IP strategy will not have to change their IP strategy, even if they grow over time into larger, established companies.
