Abstract: Forced and voluntary migration in the context of climate change and its adverse impacts are on the rise. While people displaced within their country are protected by the Guiding Principles on Internal Displacement and the human rights law underlying it, no coherent protection regime exists for those moving across borders. However, agreements on the free movement of persons providing pathways for people migrating in anticipation, during, or in the aftermath of climate-related disasters; provisions in domestic law on humanitarian entry and stay such as temporary protection and humanitarian visa arrangements; and, in some cases, refugee and human rights law provide elements to build on to enhance the protection of people moving in the context of climate change.
