Abstract:
The Council of Europe, a body with a human rights mandate composed of 46 European states, has played an enormous role in standard setting regarding migrants’ rights and states’ duties towards them. This entry examines the legal standard setting in the form of conventions which have been negotiated in this regional context and their ratification, the political standard setting of the Council of Europe institutions, and the judicial interpretation of these standards provided by the European Court of Human Rights, also a part of the Council of Europe. The contribution finishes with a review of the current challenges.
