Abstract:
This entry deals with the lawfulness of restrictions on the right to personal liberty in the migration context under international and regional human rights law as well as international refugee and migration law. It shows that contemporary practices of immigration detention are often not respectful of the human rights of migrants, in particular when it comes to conditions of detention, legal remedies, criminalization, de facto detention and border procedures, and the detention of minors. As such, immigration detention serves as a litmus test for the human rights of migrants in a world where rights and territory remain firmly linked.
