Abstract:
This entry explains why diasporas remained out of the international lawyer's loop for a long time and why this is and should now be changing. Offering a brief overview of the concept of diasporas in other disciplines, as well as its many understandings and transformations, the entry particularly spotlights changing practices by international organizations and states. Their focus on diasporas, and particularly the intensifying diaspora outreach by states, requires the attention of international lawyers, including international migration lawyers. Diaspora engagement in its intrusive form demands a rethinking of international legal concepts for protective purposes. More positively, the emphasis on relations with the state of origin may also enrich international migration law as it places questions of external franchise, dual citizenship, and consular services and rights in the limelight.
