Abstract: Migrant workers are a special category of labour migrants who reside in a different state than the state of employment. Although in many parts of the globe frontier workers are an essential element of regional labour markets, their legal treatment is far from straightforward. The lack of a universally accepted definition and their exclusion from the personal scope of international agreements addressing migrants and their rights increases their vulnerability to rights deprivation. Because frontier workers fall within two different jurisdictions, that of the state of employment and that of the state of residence, many experience a protection gap when it comes to their social and tax protection. The advent of new forms of work, such as teleworking which gained impetus during the COVID-19 pandemic, brings extra challenges for ensuring the protection of this group of labour migrants.
