Abstract:
The term ‘asylum seeker’ is not defined in any international instrument. The UN Refugee Agency (UNHCR) defines it as a general term for any person who is seeking international protection (refugee status, complementary protection) and has not yet received a final decision on their claim. The concept of asylum seeker is intimately linked to the right to seek asylum, guaranteed by Article 14 of the 1948 Universal Declaration of Human Rights, that protects the right of everyone to seek asylum from persecution, and by international human rights instruments. Asylum seekers are entitled to certain basic standards of treatment under international law aimed at protecting refugees and other persons entitled to protection, including non-discrimination, access to courts, the prohibition of penalties on account of their illegal presence, and non-refoulement.
