Abstract:
This entry describes how cooperation in the field of migration is regulated through bilateral agreements and critically analyzes the form and content of such agreements. After an overview containing a concise description and a brief historical evolution of bilateral agreements, this entry defines and discusses the main features and the major challenges and controversies of such instruments from the standpoint of international law. It particularly focuses on the recent trend to substitute proper formal agreements with informal arrangements and on the gaps in the protection of human rights when it comes to negotiate and then to apply bilateral agreements, especially readmission agreements.
