Abstract: Mass influx can be defined as the large-scale and rapid arrival of forcibly displaced persons at the host state(s) border(s). There is no binding international instrument defining mass influx and prescribing how states should respond to large-scale arrivals of refugees. Nevertheless, mass influx usually overwhelms the asylum and reception capacity of host states and renders individual refugee status determination impracticable or impossible. Overwhelmed with the number of arrivals, states facing a mass influx situation usually close their borders or implement policies such as temporary protection or prima facie refugee recognition. The absence of an international legal framework governing mass influx means that a number of questions remain with regard to mass influx, including, but not limited to: (a) whether there is a legal obligation to share the burdens and responsibilities of a state facing mass influx, (b) whether mass influx provides a valid reason for signatories to derogate from the Refugee Convention, and (c) whether the principle of non-refoulement and the prohibition of collective expulsion apply in mass influx situations.
