Abstract:
In recent years, states have been increasingly committed to protecting ‘vulnerable’ migrants and refugees, but despite the broad and frequent use of vulnerability in legal and policy documents, the concept remains relatively vague. This entry traces the historical evolution of vulnerability in the field of migration and asylum and interrogates some of the terminological issues inherent in the legally non-existent and often vague description of vulnerability. In a final analysis, by asking the question, ‘which migrant vulnerabilities require state action, and what type of action is required?’ this entry teases three main legal approaches to vulnerability that could positively and substantively influence decisions in claims for protection.
