Abstract: Protracted displacement, on the rise globally, is not a new phenomenon but has spurred increasing international responses over the last two decades, including reinvigorated policy interest and a string of political commitments pledging to provide durable solutions and address the root causes of forced displacement while promoting the self-reliance of forcibly displaced populations. Its persistence and growing scale nonetheless point to enduring gaps in international law and policy and lapses by international actors, which continue to hinder prospects of resolution. These include, most significantly, the contradiction between global commitments and local needs, a widening North–South divide in asylum, and a poor grasp of state duties and accountability for protracted displacement. Aside from critical attention to the latter challenges, a legal response to protracted displacement going forward would warrant a closer inquiry into bottom-up approaches to durable solutions, the role of regional approaches in addressing protracted displacement, and strengthening accountability measures, among others.
